LIDL RECRUITING PORTAL – TERMS OF USE

1    General
 

1.1    These terms of use ("Terms of Use") shall govern the use of the Lidl Recruitment Portal ("Platform") as between the applicant ("User") and Lidl Stiftung & Co. KG, Stiftsbergstraße 1, 74167 Neckarsulm, Germany ("Lidl"). 

1.2    The User may access the current version of the Terms of Use online or download or print them out at any time. Lidl does not save the text of this agreement after contracting.

1.3    These Terms of Use constitute the sole contractual basis for registering as a User for the Platform and using it. Any conflicting standard terms and conditions of the User shall be excluded even if Lidl does not expressly object to them.
 

2    Registration/formation of contract
 

2.1    Users must register in order to use the Platform. The User submits a binding offer to register by entering the required information and clicking on the "[Create Account]" button ("Offer to Register"). Up until the "[Create Account]" button has been clicked, the User may cancel the registration process at any time or change the information provided by deleting, adding or correcting the information in the various fields or by closing the browser. 

2.2    The agreement on registration ("Agreement“) between Lidl and the User on the conditions set forth in these Terms of Use shall be formed when Lidl confirms receipt of an Offer to Register sent to it via the e-mail address provided by the User during the registration process ("Confirmation of Receipt"). The Confirmation of Receipt also constitutes Lidl's acceptance of the Offer to Register.

2.3    To register, Users must provide the following information: last name, first name, e-mail address, country of origin. Users also select their own password upon registration, which, in combination with the e-mail address provided, enables them to log in to the Platform and access their user account. Users must handle their login data with care. In particular, Users are prohibited from disclosing their login data to third parties and/or allowing third parties to access their profile by bypassing the login data. When registering, Users are required to provide all of the necessary information truthfully and in full. Users are responsible for keeping their contact details (in particular their e-mail address) up to date and for ensuring that they can be reached at the address provided and that the e-mail address is not transferred to another person. If the User's information changes, the User must promptly amend and correct such information. If the information provided by the User is incomplete or incorrect, and the User fails to clarify the situation or continues acting in breach of contract even after Lidl's request for compliance within a reasonable period, Lidl may temporarily or permanently block the User's account and access to the Platform.

2.4    Only one user account per User is allowed. The user account may not be transferred to another person. 
 

3    Services
 

3.1    The Platform serves as the central point of contact for Users who are interested in employment at one of the many Lidl locations worldwide and wish to be kept up to date.

3.2    The Platform offers Users a variety of possible uses ("Services") which are presented and explained on the Platform. These comprise the following or similar Services:
•    Apply for national and international job offers
•    Cloud storage for application documents
•    View the status of open applications
•    Appointment overview and management (e.g., overview of upcoming job interviews, assessment center)
•    Configure job alerts to receive notifications about new job offers
•    Options to consider job offers both in Germany and abroad, according to the User's visibility settings
•    Global talent pooling and thus opportunities to participate in talent relationship management activities (e.g., info mailings or invitations to events)

3.3    The User may, after giving separate prior consent to Lidl where applicable, access individual Services, such as global talent pooling. The Platform will clearly advise the User of the consent requirement in this respect. Users may revoke their consent at any time in the visibility settings of their user account.

3.4    To apply for job offers on the Platform, Users may also be required to provide application documentation. The Platform will advise Users of what documents are required to apply for a job offer. 
 

4    Costs
 

4.1    Use of the Platform and its Services is free of charge to registered Users.

4.2    Users themselves are responsible for ensuring they have the necessary hardware and Internet connection to use our Platform. Any costs incurred for this shall be borne by the Users themselves.
 

5    Obligations of the User
 

5.1    The User undertakes vis-à-vis Lidl not to upload any content, which by virtue of its substance, form or design or otherwise violates applicable law or ethical standards (in German: ‘Gute Sitten’). In particular, the User shall not infringe the rights of third parties (e.g., name, trademark, copyright, image and data protection rights) when uploading content.

5.2    The User shall refrain from any activity that could impair the Platform's operation or its underlying technical infrastructure. 

5.3    If disruptions occur while using the Platform or its functionalities, the User shall notify Lidl of such disruption without undue delay. 

5.4    The User is required to provide all of the applicant information truthfully and in full. If the User fails to provide any or all of the documents necessary for an application, the User will not be able to apply for the job or will be excluded from the application process. Any other rights or claims of Lidl are hereby reserved.

5.5    By submitting an application, the User warrants that all information and references in the application are current, true and correct.

 

6    Intellectual property, reservation of rights

Lidl is and remains the holder of the copyright and other intellectual property rights in connection with the operation and use of the Platform.

 

7    Amendment of the Terms of Use

If there is a valid reason to amend these Terms of Use that was not foreseeable at the time of contracting and such amendment does not unreasonably disadvantage the User, in particular because the cost/benefit ratio does not disproportionately shift to the detriment of the User, Lidl shall be entitled to amend these Terms of Use, in whole or in part, with prospective effect. Such valid reasons shall include regulatory or legal reasons, security reasons, enhancing, optimizing or adding Services, making technical adjustments and ensuring the functionality of the Platform.
Lidl shall notify the User of any amendments to the Terms of Use by e-mail at least eight weeks before they enter into effect ("Notice of Amendment"). Amendments shall be deemed approved if the User, after having received the Notice of Amendment, does not expressly object to them on or before the date on which they enter into force. Lidl shall specifically advise the User in the Notice of Amendment of this legal consequence, the start of the period, the deadline and the date on which the amendment enters into force. 
 

8    Liability
 

8.1    Lidl endeavors at all times to ensure uninterrupted availability of the Platform and its Services and that data transfers function properly. However, due to the nature of the Internet, Lidl can make no guarantees in this regard. Access to the Platform and the user account may also be occasionally interrupted or restricted to allow repairs, maintenance or in order to introduce new functions and Services.

8.2    Furthermore, Lidl assumes no responsibility for disruptions in the operation of the Platform where the grounds for any such disruption are outside Lidl's sphere of control.

8.3    Lidl’s liability shall be unlimited to the extent that loss or damage is due to a willful or grossly negligent breach of duty by Lidl, its statutory representative or vicarious agent.
Lidl shall also be liable for the negligent breach of material contractual obligations. Material contractual obligations are obligations the breach of which would jeopardize the contractual purpose or the satisfaction of which is essential to the due and proper performance of the contract and on the fulfillment of which the User may generally rely. In such case, Lidl's liability shall be limited to reasonably foreseeable loss or damage at the time of contracting. Lidl shall not be liable for the negligent breach of duties other than those specified in the aforementioned sentence.
The aforementioned limitations of liability shall not apply in the event of damage culpably caused by injury to life, limb or health, for assumed guarantees, for claims under the German Product Liability Act (Produkthaftungsgesetz) or for fraudulently concealed defects. 

8.4    To the extent that Lidl's liability is disclaimed or limited, this shall also apply with respect to the personal liability of Lidl’s employees, representatives and vicarious agents.

9    Term and termination

9.1    The Agreement is entered into for an indefinite term. The contractual term shall commence on the date of contracting.

9.2    Both Lidl and the User shall have the right to terminate the Agreement with immediate effect at any time without stating reasons.

9.3    The User may terminate the Agreement by going to "Options" in their user profile and selecting "Delete Profile" and then confirming their selection. Alternatively the User may give notice of termination to Lidl in writing or by e-mail.

9.4    Upon termination of the Agreement, Lidl will delete the User's personal data that we have stored within 24 hours of receipt of the notice of termination, or store the data in anonymized form, unless processing is required by law or for another purpose.

9.5    In the event of termination, the User will no longer have access to their profile and the uploaded content.

10    Governing law and miscellaneous provisions

The Agreement between the User and Lidl set forth in these Terms of Use shall be governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the User is a consumer and is not resident in the Federal Republic of Germany, the contractual relationship shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the CISG, unless mandatory provisions of the laws of the jurisdiction in which the consumer is habitually resident provide otherwise.
 

 10.1    The contract language is English.

10.2    Should any provision of these Terms of Use be or become invalid, this shall not affect the validity of the other provisions hereof.
